Pothole

The case of the week deals with a women who tripped and fell in a pothole located in a store parking lot. We are going to call her Patricia in order to protect her identity. Patricia went shopping for a coat on the date of incident. She parked the vehicle and then proceeds to walk towards the entrance to the store when she tripped and fell on the ground. As a result of her fall, she sustained a fracture on her shoulder as well as her wrist. She was taken by ambulance from the scene of the accident to the hospital and thereafter received medical care. Shortly after the accident Patricia retained the services of our office to help her with her situation. The first thing that our law office did for Patricia was go to the site of the incident with her. We also had a professional licensed engineer go to the site to take pictures and prepare a professional report. Both the personal inspection by our office as well as the engineer’s report revealed a defect in the sidewalk which consisted of a pothole that was left behind after a construction job at the parking lot. These discoveries lead to our office commencing an action against the store as well as the owners of the property where the incident took place. In turn the owners of the property as well as the store started a third action against the construction company. That in turn resulted in the construction company starting an action against various subcontractors at the site. As you can tell the litigation became very extensive. It was further complicated by the fact that Patricia had a prior accident involving similar parts of her body. However, as a result of the aggressive pursuant of the litigation on behalf of Patricia our office was able to settle her case for $75,000.00. While each case is unique in facts and the results of past cases are no assurance of a result of a future outcome, we certainly are glad we were able to help our client in this case.

Eso a su vez resultó en que la empresa constructora iniciara una acción contra varios subcontratistas. Como pueden ver, el litigio se hizo muy extenso. Se complicó aún más por el hecho de que Patricia había tenido un accidente anterior que involucró partes similares de su cuerpo. Sin embargo, como resultado de la prosecución agresiva del litigio en nombre de Patricia, nuestra oficina pudo llegar a un acuerdo en su caso por $75,000.00.
